San Francisco Preparing to Settle with NRA

Looks like we might get another win.  This doesn’t get us incorporation, but this is why multiple suits were filed.   A win is a win, even if it doesn’t set precedent.

  1. Crotalus Said,

Don’t we already have incorporation via the 14A? If we do, then the states are ignoring the inconvenient parts of it, such as the 2A, and they will continue to ignore other incorporation laws, won’t they?

  2. Sebastian Said,

We sort of do, if you follow Supreme Court incorporation precedent, but until the Supreme Court says it’s incorporated, it probably won’t be in most federal circuits that have existing precedent that says the Second Amendment only applies to the federal government.

  3. JJR Said,

Which is why the cases in Chicago, etc, are so important. Once one of them topples via the incorporation issue, they’re all going to fall.
